2. Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 352, 351(2) and 3(5) of B.N.S., 2023.
3. Learned counsel for the petitioners submits that petitioners no.1 and 2 have antecedents of two cases and rest of

No.76011 of 2025(2) dt.18-12-2025 2/3 the petitioners are persons with clean antecedent and petitioners no.4 and 6 are women and the informant alleges that on 14.06.2025 at 09:30 a.m., accused Rahamatullah, Md. Rasul, Rustam and Manjur came to his house on account of existing land dispute and started abusing his wife, on objection, Rahamatullah by rod assaulted him causing injury on head, further, accused persons also assaulted his wife, aunt, sons and daughter who came to save him, on alarm, other accused persons named in the FIR came and assaulted him and his family members.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegations, as alleged in the FIR, it would manifest that a land dispute is existing in between the parties. It is also submitted that from side of the petitioners Khajauli P.S. Case No.115 of 2025 has been instituted against the informant and his side. It is next submitted that even injury suffered by the injured has been opined to be simple in nature and specific allegation of assault is against Rahamatullah who was granted the privilege of anticipatory bail by an order dated 27.11.2025 in Cr. Misc. No.76994 of 2025 passed by a learned Coordinate Bench.

Learned APP and the learned counsel appearing on behalf of the informant oppose the anticipatory bail application but then are not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioners that Rahamatullah has been granted the privilege of anticipatory bail.
6. Considering the submissions made by the learned counsel for the petitioners, let petitioners, abovenamed, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Khajauli P.S. Case No.122 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
