The petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 448, 427, 323, 341, 307 and 120B of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 13.07.2022.
Learned counsel for the petitioner further submits that petitioner, prior to the institution of the present FIR was a person with clean antecedent but, subsequently, after institution of the present FIR, he came to be implicated in two other cases relating to the same incident. Learned counsel next submits that

No.508 of 2023(2) dt.29-04-2023 2/2 the petitioner is not named in the FIR and the allegation in nutshell is that an unruly mob of about thousands of people armed with bamboo, iron rod, brick stones attacked the house of Deputy Chief Minister causing damage to vehicles, CCTV camera and window panes.
Learned counsel submits that the petitioner was not arrested from the spot nor he was named in the FIR and his name transpired during the course of investigation. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody, is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bettiah City P.S. Case No. 461 of 2022.
