JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Piprasi P.S. Case No. 43 of 2018, dated 24.07.2018, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. After some arguments, Mr. Ashok Kumar Gupta, learned counsel for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to surrender before the Court below and seek regular bail. The petition is, accordingly, dismissed as

In case, the petitioner surrenders before the Court below within a period of four weeks from today and seeks regular bail, the Court below shall take into account that though recovery is shown from a tea-shop, but in the absence of the petitioner and that he has no criminal antecedents and, thereafter, shall pass orders in accordance with the law without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
