Petitioner seeks bail in Complaint Case No. 2588 of 2017 registered for the offences punishable under Sections 498-A of the Indian Penal Code and 3⁄4 of the D.P. Act. Complainant is the wife of the petitioner who has alleged torture by the petitioner for non-fulfillment of the demand of dowry.
It is submitted on behalf of the petitioner that his antecedent is clean and the allegation made against him is false and concocted. Petitioner has stated that the informantcomplainant is not his wife and, as such, there is no question of demand of dowry or torture meted out to her.

No.68310 of 2018(2) dt.30-11-2018 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Sadar, Champaran at Motihari in connection with Complaint Case No. C-2588 of 2017 with following conditions:- (1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
