JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2018 The petitioner seeks regular bail in connection with Excise Case No. 1406 of 2018 arising out of Ara Nawada P.S. Case No. 601 of 2018, registered for offences punishable under Section 30(a) of Bihar Prohibition of Liquor and Excise Act, 2016.
Allegation is of recovery of 80 liters liquor from the vehicle and petitioner is named in the F.I.R. Submission of learned counsel for the petitioner is that recovery is made from the vehicle, which is of co-accused Vikash Kumar. Further submission is that the petitioner has no criminal antecedents and he is in judicial custody since 05.09.2018.
Heard learned A.P.P. also.
Having heard both sides, in view of the above facts,
Patna High Court Cr.Misc. No.67398 of 2018(2) dt.27-11-2018 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge-cum-Special Judge, Excise, Bhojpur, Ara, in connection with Excise Case No. 1406 of 2018 arising out of Ara Nawada P.S. Case No. 601 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
