The petitioner is apprehending arrest in a case registered under Sections 366A, 504/34 of the Indian Penal Code. Allegedly, the minor daughter of the informant was kidnapped by the accused-petitioner.

It has been submitted on behalf of the petitioners that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The victim has been recovered. Her statement u/S 164 of the Cr.P.C. was recorded in which she has made statement that she had love affairs and out of her own sweet will, she left her house with the petitioner. The allegation, made in the FIR is denied by the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-X, Muzaffarpur in connection with Hathauri P.S. Case No. 259 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
