The petitioner has filed the instant application for grant of regular bail in connection with Bagaha Patkhauli P.S. Case No. 481 of 2019 registered under section 392 of the Indian Penal Code.

Prosecution case in short, is that, when the informant was going to deposit Rs. 8,88,700/- belonging to Bharat Financial Inclusion Limited Company, in which he was working as cashier, on the way the above said amount was snatched by two miscreants, who came suddenly on a bike.

Patna High Court CR. MISC. No.814 of 2023(2) dt.27-03-2023 2/3 Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case merely on suspicion. The petitioner is not named in F.I.R. rather he has been made accused in this case during the course of investigation only on the basis of restatement of one Babunand Kumar Ram, who in earlier statement did not disclose the name of this petitioner. Further, nothing looted money has been recovered from his conscious possession but on the basis of his criminal antecedent, police in connivance with the informant implicated him in this case. He has not been put on TIP even after one year and ten months of his arrest. He is languishing in judicial custody since 19.07.2021.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Bagaha Pathkhauli P.S. Case No. 481 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the
