The petitioner is apprehending his arrest in connection with Bhabua P.S.Case No.853 of 2018 registered for offences punishable under Sections 302/34 of the Indian Penal Code. As per FIR, one Ayodhya Pal has assaulted by Farsa on the head and Madho Pal has assaulted by Lathi causing injury to the wife of the informant.

Submission of the learned counsel for the petitioner is that the main allegation is against Ayodhya Pal as well as only one injury was found.

Heard learned A.P.P. , who has opposed the prayer for bail on the ground that there is allegation against this petitioner also of assault. .

Having heard both sides and in view of the facts and

Patna High Court CR. MISC. No.70063 of 2019(3) dt.26-11-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail.

With the aforesaid direction, this application is dismissed.
