The petitioner apprehends his arrest in Madanpur P.S. Case No. 370 of 2022 registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code and Rules 11/18/43/56 of the BMMRC Rules, pending in the Court of learned C.J.M., Aurangabad.

Learned counsel for the petitioner submits that one of the co-accused has been granted regular bail by the learned Court Below.

After some arguments, learned counsel for the petitioners seeks permission to withdraw this application. Permission is granted.

Patna High Court CR. MISC. No.752 of 2023(3) dt.06-04-2023 2/2 Accordingly, the instant application is dismissed as withdrawn. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order.
