2. In this case, the petitioner is seeking regular bail in connection with Sadar Kajipur P.S. Case No. 690 of 2023, registered for the offences punishable under Sections 341, 323, 379, 420, 506, 34 of the IPC and chargesheet has been submitted under Sections 395 and 397 of IPC.

3. As per allegation, when informant was going to Arsad Nagar, on the way, four unknown persons stopped his vehicle and started assaulting him and snatched his mobile. After that, through pay phone of his mobile, they transferred Rs.90,000/- and Rs.14,400/-. After that, they thrown his mobile phone and fled away.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

He is not named in the FIR and his name transpired on the basis of confessional statement of co-accused Nitin Kumar. He is a person of clean antecedent. The petitioner is under custody since 28.02.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances as well as clean antecedent of the petitioner, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Sadar Kajipur P.S. Case No. 690 of 2023, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

7. Before accepting the bail bond, the learned court below shall verify the criminal antecedent of the petitioner and if it is found that he is involved in any other case of similar nature except the present one, his bail bond shall not be accepted. (Nawneet Kumar Pandey, J) priyanka/- U T
