2. Petitioner seeks regular bail in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 117(2), 117(4), 109, 103, 190, 191(2) and 191(3) of the Bhartiya Nyaya Sanhita, 2023.
3. Prosecution case, in brief, is that on 12.01.2025 at 10:00 A.M., informant received information that all the F.I.R. named accused persons, including this petitioner, were forcibly ploughing field of informant by tractor. On protest by husband and other family members of the informant, the accused persons assaulted them by means of iron rod, lathi etc. as a result of which husband of the informant died on the way to hospital.
4. Learned counsel for the petitioner submits that the incident occurred due to land dispute in which free fight took

As per the FIR, petitioner and other accused persons assaulted father of the informant with iron rod, but post mortem report does not support the prosecution case. Doctor has found only one injury on the head of the deceased. Petitioner claims clean antecedent and he is in custody since 18.01.2025.
5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.
6. Considering backdrop of the case, nature of accusation and custody of the petitioner, let the petitioner named above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 2nd, Bagaha, West Champaran in connection with Bhathwariya P.S. Case No. 02 of 2025.
