2. The petitioner seeks bail in connection with Bihar P.S. Case No. 425 of 2025 registered for the offence under Section 126(2), 115(2), 64(1), 62 of BNS.

3. The petitioner is named in the F.I.R. and is in custody since 12.07.2025.

4. The allegation against the petitioner is to commit sexual assault upon informant aged about 18 years while she was alone in her room.

5. Learned counsel appearing on behalf of the petitioner submitted that as some scuffle took place between

Case No. 426 of 2025 dated 12.07.2025 was lodged and just to counter the aforesaid FIR the present false implication was raised. It is submitted that injury received by this petitioner was due to assault by the brother of the informant and not by the informant as alleged. It is also submitted that upon medical examination nothing incriminating appears surfaced as to connect petitioner with present crime. While concluding the argument, it is submitted that petitioner is a man of clean antecedent and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

6. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of nature of nature of accusation, which appears prima-facie raised in the background of enmities as discussed, coupled with fact that investigation of this case already completed where petitioner remains in custody since 12.07.2025, accordingly petitioner above named, is directed

Patna High Court CR. MISC. No.75204 of 2025(2) dt.10-11-2025 3/3 to be released on bail in connection with Bihar P.S. Case No. 425 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Biharsharif /concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C/ Section 480(3) of BNSS.
