Petitioner seeks bail in Special (Excise) Case No.345 of 2018 arising out of Mahishi (Jalai OP) P.S. Case No.147 of 2018 instituted for the offence under Section(s) Section 30-A, 38(i), 41(i) of the Bihar Prohibition & Excise Act, 2016 pending in the Court of the Special Judge, Excise Act, Saharsa.
It is alleged that total 3281 litres foreign liquor has been recovered from the truck, which was being driven by this petitioner. The petitioner could not produce any valid paper with regard to loading of aforesaid liquor.
There is total prohibition of sale and purchase of liquor in Bihar.
Patna High Court Cr.Misc. No.65177 of 2018 (2) dt.02-11-2018 2/2 In such circumstances, this Court is not inclined to enlarge the petitioner on bail.
Prayer of the petitioner for grant of bail is rejected at this stage.
Petitioner may renew his prayer for bail after six months.
