The petitioner seeks bail in connection with Special (POCSO) Case No.147 of 2019 arising out of Agamkuan P.S. Case No.707 of 2019 registered under Sections 323, 341, 354, 354A, 427, 504, 506 read with 34 of the Indian Penal Code and Sections 8 and 12 of the Protection of Children from Sexual Offences Act.

It is submitted by the learned counsel for the petitioner that the petitioner and the informant are neighbours. He has been made accused in the case along with his parents. It is unbelievable that a son would molest a girl in presence of his parents. He has further contended that no occurrence as alleged had ever taken place, but only because of some petty dispute the

Learned counsel for the State has opposed the prayer for grant of bail to the petitioner.

Considering the nature of the offence, the period undergone by the petitioner in custody, the submission made by the learned counsel for the petitioner that charge has already been framed and custodial interrogation of the petitioner is not warranted, the prayer for bail is allowed. The petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.D.J.-I-cumSpecial Judge, POCSO, Patna in connection with Special (POCSO) Case No.147 of 2019 arising out of Agamkuan P.S. Case No.707 of 2019.
