====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 13-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner in the present case is seeking regular bail in connection with Special Case No. 04/2019 and F. No. NCB/PZU/V/02/2019 registered under Sections 20/25/29 of the N.D.P.S. Act, pending in the court of learned Additional District & Sessions Judge - XX - cum - Special Judge, Patna. Learned counsel for the petitioner submits that petitioner is neither the truck owner nor the Khalasi or driver of the said Truck, he had no knowledge of the Ganja which was loaded in the Truck. Learned counsel submits that petitioner was coming from Agartalla to his house and on the way he demanded lift then he sat on the said Truck, however petitioner

Learned A.P.P. for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case wherein huge quantity of about seven quintals of Ganja have been recovered from the Truck in which this petitioner is said to be the Khalasi, though learned counsel for the petitioner has disputed the same saying that he was only a passerby and had taken lift, the petitioner is being in custody only since 11.01.2019, this court is not inclined to grant regular bail to the petitioner at this stage.

The application is dismissed.

Let the trial of this case be expedited.
