1. Heard the parties.

2. The petitioner has renewed her prayer for regular bail in connection with S. Tr. No. 740 / 2025 arising out of Fatehpur P.S. Case No. 197 / 2024 dated 05.04.2024 registered for the offence punishable under section 304(B) / 34 of the I.P.C.

3. The bail application of the petitioner was earlier rejected on 19.03.2025 on merit vide Cr. Misc. No. 17992 of 2025.

4. It is a case of dowry death. The petitioner is the motherin-law of the deceased.

5. Learned counsel for the petitioner submits that charge has been framed on 23.08.2025 but no prosecution witness has been examined as yet.

6. This court has called for a report regarding the present stage of the trial vide order dated 07.11.2025 and in pursuance

Patna High Court CR. MISC. No.76353 of 2025(3) dt.12-12-2025 2/2 thereof learned District & Additional Sessions Judge-II, Gaya has submitted his report vide letter no. 432 dated 01.12.2025 stating therein that out of nine prosecution witness none has been examined. Charge has been framed on 23.08.2025. Petitioner is in custody since 15.01.2025.

Regard being had to the submissions made by the parties, taking into consideration the period of custody, fact that trial is not likely to be concluded in near future and this is second attempt for bail on behalf of the petitioner, accordingly, I am inclined to grant regular bail to the petitioner.

8. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II, Gaya in connection with S. Tr. No. 740 / 2025 arising out of Fatehpur P.S. Case No. 197 of 2024.
