JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2018 The petitioner seeks regular bail in connection with Gaurichak P.S. Case No. 64 of 2017, registered for offences punishable under Sections 364, 201 and 34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the husband of informant.

It has been submitted on behalf of the petitioner that petitioner is not named in the F.I.R., his name has been dragged in this case during investigation only on the basis of suspicion and except confessional statement, there is nothing against the petitioner and he has been in custody since 08.08.2018 and other co-accused persons have been granted bail by a coordinate Bench of this Court vide order dated 17.02.2018

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -VII, Patna City, Patna in connection with Gaurichak P.S. Case No. 64 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
