JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 Petitioner seeks bail in anticipation of her arrest in connection with Sitamarhi P.S. Case No. 237 of 2019, registered for the offences punishable under Sections 304 (B) 34 of the Indian Penal Code.
Petitioners are happens to be married Nanand in a case under Section 304 (B) of the I.P.C.
Submission of the learned counsel for the petitioner is that she has stated on her oath that she is residing at her marital house at Daltanganj in the state of Jharkhand and she was not present at the time of occurrence, deceased has committed suicide by hanging herself and ligature mark has been found which appears from autopsy report of the deceased. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No.-237 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
