The petitioner is accused in connection with Nowkothi P.S. Case No. 93 of 2018, registered under Section 399(A)/34 of the Indian Penal Code.

The accusation is of kidnapping of Neha Kumari, daughter of informant, Manju Devi, by Dayanand Choudhary and Suhodh Kumar Choudhary (petitioner).

Learned counsel for the petitioner submits that, in fact, co-accused, Dayanand Choudhry, is co-villager of informant and this petitioner, being relative of Dayanand Choudahry, used to visit at the house of Dayanand Choudhary

Patna High Court CR. MISC. No.86692 of 2019(2) dt.18-01-2020 2/2 due to that reason he has falsely been implicated in the present case. It is further submitted that petitioner has no criminal antecedent and is in custody since 12.07.2019 and on investigation, the charge sheet has already been submitted against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Begusarai, in connection with Nowkothi P.S. Case No. 93 of 2018. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
