The petitioner seeks bail in connection with Dhansoi Police Station Case No. 82 of 2019, registered for the offences punishable under Sections 25 (1-B)a/26 of the Arms Act, 1959. The allegation against the petitioner is that the police recovered a country-made pistol from the house of the petitioner.
Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in the present case with oblique motive inasmuch as the petitioner has solemnized marriage with the daughter of one Dharmnath Sharma, who is the influential person of the locality, against his will and he has been implicated in this case at the behest of said Dharmnath
Patna High Court CR. MISC. No.70688 of 2019(2) dt.11-12-2019 2/2 Sharma. He further submits that the petitioner is in custody since 10.06.2019.
Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner is in judicial custody since 10.06.2019, I am inclined to enlarge the petitioner on bail.
This application is, accordingly, allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Chief Judicial Magistrate, Buxar, in connection with Dhansoi Police Station Case No. 82 of 2019.
