The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 341, 323, 354, 379, 427 and 504 of the IPC.
The prosecution case, as per the written report of Munni Devi, dated 20.08.2018, submitted to the Station House Officer, Baliya Police Station, is to the effect that all the accused persons including the petitioners came to the house of the informant and started abusing her. They also assaulted Savitri Devi and Munni Devi with a rod and country made pistol. The accused persons pressurized the informant to withdraw the earlier case lodged
Patna High Court Cr.Misc. No.71618 of 2018(2) dt.21-12-2018 2/3 against them. It is specifically alleged that the petitioner no.1, Manoj Tanti took out Rs. 500/- from the house of the informant, whereas petitioner no.2, Haris Kumar and co-accused Sogarath Tanti misbehaved with the lady family members of the informant.
It is submitted by learned counsel for the petitioners that in the background of an earlier dispute, the accusation has been levelled. There is a counter version of the occurrence also, being Ballia P.S. Case No. 235 of 2018, registered under Sections 147, 341, 323, 354, 379, 427 and 504 of the IPC. It is further submitted that from the FIR as well as the impugned order, it does not appear that anyone has received any grievous injury. Learned APP submits that the petitioners are named in the FIR.
Considering the general and omnibus accusation against the petitioners and the fact that there is counter versions of the occurrence also, let the above named petitioners be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned CJM, Begusarai in connection with Ballia
