This application for bail arises out of Dhamdaha P.S. Case No. 176/2017 for the offences under Section 147/148/149/323/341/353/332/337/307 and 427 of the Indian Penal Code.
There are 10 persons named and 15-20 not known, who have committed the offence. The petitioners are not named. The Assistant Sub-Inspector of Police of the concerned police station is the informant, according to whom, when he was on duty, he had found 15-20 persons assaulting the informant of another case and when the informant intervened, some of them attacked the police party and assaulted the police force. Some of the criminals also attempted to snatch the rifles of the police

Learned counsel appearing on behalf of the petitioners contends that they have been impleaded only on the basis of the information of 'spy', who is not named anywhere. The petitioners have no criminal antecedents.
Considering the submissions, the application is allowed.
Let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Purnea in Dhamdaha P.S. Case No. 176/2017.
