The petitioners have filed the instant application for grant of bail in a case registered for the offence under sections 414, 401 and 34 of the Indian Penal Code.
As per the allegation in the FIR, four accused persons including the three petitioners were caught with a stolen motorcycle.
It is submitted by learned counsel for the petitioners that no recovery as alleged has taken place, the petitioners have no criminal antecedent and are in custody since 19.08.2019. It is further submitted that charge sheet has been submitted in the
Patna High Court CR. MISC. No.77738 of 2019(3) dt.10-12-2019 2/2 case.
The application for bail has been opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioners on bail. Let the petitioners above named be enlarged on bail on each of them furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 3rd, West Muzaffarpur in connection with Kudhani P.S. Case No. 539 of 2019.
