====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 10-12-2018 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Rail P.S. Samastipur Case No. 217 of 2018, instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016. It is alleged in the written report that 18 bottles each containing 750 ml, six bottles each containing 750 ml of VAT69 Blended Scotch Whisky and 11 bottles each containing 750 ml. of hundred pipers deluxe blended Scotch Whisky have been recovered from the bags keeping beneath Seat No. 13. It is further alleged that petitioner claimed before the police that bags as mentioned in the seizure list belongs to him. From the seizure list it appears that there is no

Patna High Court Cr.Misc. No.70954 of 2018(2) dt.10-12-2018 2/2 recovery from conscious possession of this petitioner. In the seizure list it is mentioned that seizure has been made at Samastipur Railway Station.

Petitioner is in custody since 18.9.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-3-cum-Special Judge (Excise), Samastipur, in connection with Rail P.S. Samastipur Case No. 217 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
