The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that there is recovery of 375 ml. of foreign liquor from the side of the road and there is no recovery from the conscious possession of the petitioner. The petitioner is a student and motorcycle not belong to the petitioner. The petitioner has no criminal antecedent. In the aforesaid facts and circumstances of the case, I am inclined to grant anticipatory bail to the above named petitioner, in the event of his arrest or surrender before the court
Patna High Court CR. MISC. No. 69056 of 2019(3) dt.20-11-2019 2/2 below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Begusarai, in connection with Mansurchak P.S. Case No. 74 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. Subject to the condition that the petitioner shall deposit Rs. 5,000/- in favour of Patna High Court Legal Services Committee.
