JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-07-2020 Heard learned counsel appearing for petitioner as well as learned Additional Public Prosecutor appearing for State through video conferencing.

Petitioner apprehends his arrest in connection with Ghosi (Okari) P.S. Case No.203 of 2019 registered for the offences punishable under Sections 324, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act. There is specific allegation against the petitioner that he fired on informant causing firearm injury. The injury report of informant corroborates this fact that informant sustained firearm injury. However, learned counsel appearing for the petitioner submits that the injury of injured goes to show that injured sustained simple injury and the doctor has not specifically mentioned the weapon by which the injury was caused.

No.70778 of 2019(5) dt.09-07-2020 2/2 The perusal of order dated 27.11.2019 goes to show that the petitioner was granted provisional bail, but considering the facts and circumstances of the case as well as submissions of the parties, I am not inclined to extend the privilege of anticipatory bail to petitioner.

Accordingly, his prayer for anticipatory bail stands rejected.
