ABHISHEK REDDY ORAL ORDER 09-12-2025 Without going into the merits or demerits of the case, the present writ petition is disposed of at the stage of admission with the consent of both the Counsels.
2. The only prayer sought for in the present writ petition by the petitioner is to direct the Bihar State Waqf Tribunal i.e. Respondent No. 2 herein to dispose of the Misc. Case No. 03 of 2022 pending before it or pass necessary orders on the stay granted by the said Tribunal on 13.01.2022.
3. Learned counsel appearing on behalf of the petitioner
Patna High Court CWJC No.19764 of 2025(2) dt.09-12-2025 2/2 submits that though the petitioner has filed a vacate stay/ counteraffidavit in the Misc. Case No. 03 of 2022 and has sought vacating the interim order granted by the said Tribunal on 13.01.2022. The Tribunal is not passing any orders and the Respondent No. 3 herein taking advantage of the interim order is not taking any steps for disposal of the Misc. Case No. 03 of 2022. Learned counsel only seeks a direction to the Respondent No. 2 to dispose of the Misc. Case No. 03 of 2022 as expeditiously as possible by fixing a time frame.
4. Having regard to the above made submissions, the present writ petition is disposed of directing the Respondent No. 2 to dispose of the Misc. Case No. 03 of 2022 as expeditiously as possible preferably within a period of 12 weeks from the date of the receipt of the copy of this order. It is needless to mention that before passing any order the petitioner as well as the Respondent No. 3 herein shall be put on notice and given an opportunity of hearing. Any order passed shall be communicated to the party.
5. With the above directions, the present Writ Petition stands disposed of.
