====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Jadia P.S. Case No. 93 of 2018 instituted for the offence under Sections 147, 149, 341, 323, 307, 302, 379 and 504 of the Indian Penal Code. It is alleged in the written report that one Pappu Yadav assaulted the informant on head with lathi causing bleeding injury. It is further alleged that father of the informant came to rescue him. Thereafter, he was also assaulted by the accused persons including this petitioner with fists and slap. It is further alleged that father of the informant was also pushed by the accused persons on account of which he fell down and died.
Post mortem report of father of the informant has been enclosed as Annexure-2, wherein, the Doctor, on external
Patna High Court Cr.Misc. No.72063 of 2018(2) dt.05-12-2018 2/2 examination found one bruise on the person of deceased. The doctor has kept the opinion reserved and sent visceras for chemical analysis in Forensic Lab, Patna.
Counsel for the petitioner submits that general and omnibus allegation has been levelled against the petitioner. The co-accused Binod Yadav with similar allegation has already been granted bail by this Court vide order dated 2.11.2018 passed in Cr. Misc. 61024 of 2018.
Petitioner is said to be in custody since 13.9.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate Vth, Supaul, in connection with Jadia P.S. Case No. 93 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
