The petitioner seeks bail in Kudhani P.S. Case No. 104 of 2018 instituted for the offence under Section 392 of the Indian Penal Code.

The First Information Report is against unknown. Petitioner is not named in the First Information Report. No Test Identification Parade has been held. There is no recovery from possession of the petitioner.

Counsel for the petitioner submits that for recovery of pick-up van Baligaon P.S. Case No. 12 of 2018 has been registered. Two persons namely, Arun Chaudhary and Ram Naresh Ram were arrested. They disclosed the name of petitioner in their confessional statement in that case and on

Patna High Court Cr.Misc. No.70739 of 2018(2) dt.04-12-2018 2/2 that basis the petitioner has been made accused in the instant case.

Petitioner is said to be in custody since 4.9.2018 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-cum-Sub Judge 3rd, Muzaffarpur, in connection with Kudhani P.S. Case No. 104 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
