JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 This application, for grant of anticipatory bail, arises out of Manigachhi (Nehra O.P.) No. 123 of 2019, disclosing offences under Sections 341, 323, . 307, 354, 506, 504 and 34 of the Indian Penal Code.

Allegation as per F.I.R. is that while panchayati was going on in Madarsa, accused persons including petitioner came and assaulted the informant and others and specific allegation against this petitioner is of assault by knife on the head of one Parwez Alam.

Submission of learned counsel for the petitioner is that the occurrence took place in the spur of moment and there was no repetition of blow and as per his instruction, injury sustained by the said Parwez Alam was found simple in nature. Heard learned A.P.P. also.

No.70062 of 2019(2) dt.15-11-2019 2/2 Having heard both sides, this application is disposed of with direction to the petitioner to surrender in the court below within a period of three weeks and on surrender the court below shall release the petitioner on provisional bail and in the meantime call for the injury report to verify the nature of injury caused to the said Parwez Alam and if it is found that the injury sustained by him is simple in nature, the court below shall confirm the provisional bail of the petitioner, otherwise, petitioner has to surrender and pray for regular bail.
