====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 17-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Riga P.S. Case No. 219 of 2018 instituted for the offence under Sections 399, 402, 412 of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of the Arms Act.

Counsel for the petitioner has filed supplementary affidavit stating that after his remand in this case, he has also been remanded in other five cases which is mentioned in paragraph-2 of the case diary.

In the instant case it is alleged that one loaded country made pistol and one live cartridge has been recovered from possession of the petitioner.

Petitioner is said to be in custody since 22.7.2018. Keeping in view the period spent by the petitioner in

Patna High Court Cr.Misc. No.74453 of 2018(3) dt.17-12-2018 2/2 custody, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Riga P.S. Case No. 219 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
