JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

The prosecution case, in brief, is that when the informant was returning from Barakpur to Hajipur, three persons boarded on a motorcycle stopped the informant's motorcycle and snatched the purse containing Rs. 800/-, D.L., voter card, Adhaar Card, ATM on gun point and fled away. Butone person was caught by the passer-by. The apprehended person disclosed his name as Bipul Kumar.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated on the basis of the confessional statement of the co-accused person,

He further submitted that no stolen cards and documents were recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent. Learned counsel for the State opposes the prayer for bail.

Considering the fact that the stolen cards and documents were recovered from the conscious possession of the petitioner, prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Alok Verma/- U T
