JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-12-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Kotwali (Tilkamanjhi) P.S. Case No. 236 of 2018 for the offence under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. Referring to the prosecution case, he submits that the two persons, who allegedly committed loot, are Shambhu Sah and Pravesh and said Shambhu Sah has been granted bail by a Co-ordinate Bench of this Court vide order dated 20.08.2018 in Cr. Misc. No. 44215 of 2018.
Considering the fact that against whom there is specific allegation has been granted bail, the petitioner named
Patna High Court Cr.Misc. No.74327 of 2018(2) dt.20-12-2018 2/2 above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Tilkamanjhi) P.S. Case No. 236 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
