This application for anticipatory bail arises out of Sikandra P.S. Case No.152 of 2018, disclosing offences under Sections 147, 148,149,302,120B of the Indian Penal Code and Section 27 of the Arms Act.
Considering the fact that the petitioners are accused under Section 302 of the Indian Penal Code, in view of the Supreme Court's decision in the case of Jai Prakash Singh Vs State of Bihar reported in (2012) 4 SCC 379, I am not inclined to grant the petitioner privilege of anticipatory bail. This application is rejected.
The petitioners are directed to surrender before the
Patna High Court Cr.Misc. No.72991 of 2018(2) dt.19-12-2018 2/2 Court below within four weeks from today and seeks regular bail, if so advised, If they do so, their application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail by this Court.
