2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 498A/34 and other ancillary sections of the Indian Penal Code and sections 3 & 4 of the Dowry Prohibition Act.
3. By filing supplementary affidavit learned counsel for the petitioner submits that the dispute between the parties has been settled and compromise petition to this effect has also been filed in the Court below. Accordingly, National Lok Adalat vide order dated 11.2.2023 has disposed of Maintenance case no.187 of 2022 vide annexures 3, 4 and 5. Now opposite party no.2 is
Patna High Court CR. MISC. No.704 of 2023(5) dt.17-08-2023 2/2 living with the petitioner with all dignity.
4. Learned counsel for the opposite party no.2 does not controvert this submission.
5. Considering the aforesaid development, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Siwan in Complaint Case No. 342 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
