20-11-2019 Heard learned counsel for the parties.

The petitioners apprehend their arrest in Karakat P.S. Case No. 62 of 2019 registered for the offence under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code. Learned counsel for the petitioners submits that as per F.I.R., informant and others were assaulted by petitioners and others and petitioner no. 2 is alleged to have assaulted the informant by Rami on his head, but as per injury report, the injury is found to be simple in nature caused by hard & blunt substance and there is case and counter case in between the parties and both sides have received injury. It has further been submitted that co-accused namely Chandan Kumar has already been granted anticipatory bail by this Court, vide order dated

Patna High Court CR. MISC. No.73043 of 2019(2) dt.20-11-2019 2/2 26-09-2019 passed in Cr.Misc. No. 60786 of 2019 (Annexure - 6). He submits that petitioners are having clean antecedent. Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of arrest or surrender within a period of six weeks from today, let both petitioners above named be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bikramganj, Rohtas in connection with Karakat P.S. Case No. 62 of 2019 on the following conditions:

(1) Petitioners shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on their absence on two consecutive dates without sufficient reason, their bail-bond shall be cancelled by the Court below.

(2) If the petitioners temper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
