Petitioner seeks bail in Hawai Adda P.S. Case No.105 of 2018 (Special Case No.4852 of 2018), registered under Sections 307, 353 and other Sections of the Indian Penal Code as well as under Sections 30(A)/37(C) of Bihar Liquor Prohibition and Excise Act, 2016.

The informant, a Homeguard, alleged that two persons were raising abusive words on a road crossing after taking liquor. When the informant asked not to raise, both the accused assaulted the informant but on chase one of the accused was apprehended who disclosed his name as Prakash Kumar. Petitioner managed to flee away.

Learned counsel for the petitioner submits that simple injury was caused to the informant. Petitioner is in jail since

Patna High Court Cr.Misc. No.73588 of 2018(2) dt.11-12-2018 2/2 20.08.2018 for taking wine and assaulting the informant. Considering the nature of allegations made against the petitioner and the fact that the petitioner is in jail for about four months, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Hawai Adda P.S. Case No.105 of 2018 (Special Case No.4852 of 2018).
