1. Heard learned Counsel for the parties concerned.

2. The petitioner has filed the present writ application for quashing the order, dated 08.08.2023, passed by the Commissioner, Koshi Division, Saharsa, in Supply Revision Case No. 59 of 2022, by which the Commissioner has dismissed the revision application filed by the petitioner.

3. Learned Counsel for the State submits that the petitioner, without availing the remedy, under Rule 32 (vii) of the Bihar Targeted Public Distribution System (Control) Order, 2016, before the Principal Secretary of the

Patna High Court CWJC No.17827 of 2023(2) dt.07-11-2025 2/2 Department, has approached this Court and the petitioner may file an appropriate petition before him challenging the impugned order.

4. Considering the aforesaid submission, the petitioner is given liberty to file an appropriate petition before the Principal Secretary of the Department within a period of six weeks from today against the order, dated 08.08.2023, passed, by the Divisional Commissioner, Koshi Division, Saharsa, in Supply Revision Case No. 59 of 2022.

5. If an appropriate petition is filed before the Principal Secretary of the Department, against the order, dated 08.08.2023, passed, by the Divisional Commissioner, Koshi Division, Saharsa, in Supply Revision Case No. 59 of 2022, the Principal Secretary shall be obliged to dispose the same in accordance with law within a period of three months from the date of filing of such petition.

6. With the aforesaid observation and direction, this writ application is disposed.
