JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-03-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 326/302/34 of the Indian Penal Code.

As per the prosecution case, all the FIR named accused persons including the petitioner killed father-in-law of the informant.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Informant is not eye witness of the occurrence. It is stated in paragraph 3 of the bail petition that the petitioner has got clean antecedent. Learned counsel for the State opposes the prayer for bail submitting that the petitioner is named in the FIR with specific allegation that he along with other accused persons was

Patna High Court CR. MISC. No.514 of 2023(2) dt.24-03-2023 2/2 seen by husband of the informant in electric light fleeing away from the place where her father-in-law was lying dead in pool of blood with several injuries.

Considering the specific allegation against the petitioner, his prayer for bail is refused.
