JUSTICE RAKESH KUMAR ORAL ORDER 03-12-2018 Heard Sri Shailendra Kumar Jha, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner who is in custody since 26.07.2018 has prayed for grant of bail in connection with Jai Nagar P.S. Case No. 291 of 2018 corresponding to G.R. No. 787 of 2018 registered for the offence under Sections 272/273/34 of the Indian Penal Code, 1860 and Section 30 (a) of the Bihar Prohibition And Excise Act, 2016.

Learned counsel for the petitioner submits that in the case the petitioner has been remanded only on suspicion from an another case i.e. Jai Nagar P.S. Case No. 359 of 2018. He submits that in the case there was recovery of about 81 liters of Nepali Soufi wine which was purportedly thrown by three unknown accused persons while they were fleeing away and

Patna High Court Cr.Misc. No.70404 of 2018(2) dt.03-12-2018 2/2 F.I.R. was lodged against unknown however since petitioner was accused in an another case he has been remanded falsely in the present case.

Be that as it may, considering the nature of accusation as well as period of custody, let the petitioner Santosh Kumar Das @ Santosh Das be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand ) with two sureties of the like amount each to the satisfaction of learned IInd Addl. Sessions Judge cum Special Judge, Excise, Madhubani / concerned court in connection with Jai Nagar P.S. Case No. 291 of 2018 corresponding to G.R. No. 787 of 2018.
