Petitioner seeks bail in Nauhatta P.S. Case No.51 of 2018 registered under Sections 25(1-b) A, 26 and 35 of the Arms Act.

The police on secret informant went near the place situated in a market and found a Scooty of the petitioner parked there. Seeing the police, the petitioner and Sandeep Kumar started fleeing away. The petitioner managed to flee away but one magazine fell down from the waist of the petitioner and Sandeep Kumar was apprehended from whose possession loaded country made pistol was recovered.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in jail since

Considering the nature of allegations made against the petitioner and the fact that the petitioner has got no criminal antecedent and he is rotting in jail for more than four months, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Saharsa in connection with Nauhatta P.S. Case No.51 of 2018.
