The petitioner seeks regular bail in Barachatti P.S. Case No. 25/2016, registered for the offences punishable under Sections 18, 20 and 22 of the N.D.P.S. Act.
Learned counsel for the petitioner has submitted that petitioner has clean antecedent. There is no recovery of opium plant from the land of this petitioner. The named accused disclosed to the police that this petitioner used to give facility for such plantation. Other co-accused have already been granted bail vide order dated 10.01.2017 passed in Cr. Misc. No. 38831/2016. Petitioner is in custody since 30.06.2018 having clean antecedent.
Considering the facts and circumstances of the case,
Patna High Court Cr.Misc. No.70977 of 2018(2) dt.10-12-2018 2/2 prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned District & Sessions Judge, Gaya in connection with Barachatti P.S. Case No. 25/2016, subject to the condition that both the bailors will be close relative of the petitioner.
