The petitioners seek bail in a case registered for the offence punishable under Sections 147, 148, 341, 323, 324, 448, 307 of the Indian Penal Code.

The prosecution case is that on 14.08.2019 at about 10.00 P.M. night informant was at his door then his villager petitioners and other accused persons came with arms and abused him. When father of informant protested then co-accused Gorakh Yadav blow Dab on the father of the informant resultant he sustained cut injury on hand. Co-accused Ranjan Yadav @ Kajal Yadav assaulted father of the informant with rod then he sustained injury. Father of the informant fell down then informant came there to save his father then co-accused Sachin Yadav knife blow in the abdomen of

Patna High Court CR. MISC. No. 69115 of 2019(2) dt.25-11-2019 2/2 informant who sustained injury and intestine came out from his abdomen and he became unconscious.

Learned counsel for the petitioners submits that there is no specific allegations against the petitioners. It is specific allegation against co-accused namely Gorakh Yadav, Ranjan Yadav @ Kajal Yadav and Sachin Yadav.

Learned counsel for the petitioners further submits that accept informant and his father neither other family members have sustained injury nor they have medically examined. On the record there is no medical report available of the other family members of the informant which is mentioned in para 11 of the bail petition. The petitioners are in custody since 25.08.2019 and have got no criminal antecedent.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Ara Muffasil P.S. Case No. 234 of 2019.
