The petitioner is in custody since 31.07.2019 in connection with Case No. C-2/474/2019 for the offence registered under Sections 30 (a) of the Bihar Excise (Amendment) Act.

Learned counsel for the petitioner submits that the alleged recovery is not from the conscious possession of the petitioner but besides the Bagmati River. It is further submitted that the petitioner has no criminal antecedent.
