JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2019 The petitioner seeks regular bail in connection with Magadh Medical P.S. Case No. 148 of 2018, registered for offences punishable under Sections 302, 328 and 34 of the Indian Penal Code.

Prosecution case is that the deceased, who is the wife of the petitioner, went to reside in her matrimonial house but she was not allowed to reside in the house, thereafter, she was sitting outside the house and she was given some eatable substance and after eating the same, she started crying in pain and later on died.

It has been submitted on behalf of the petitioner as a matter of fact the materials have come in the case diary that the deceased had herself consumed poison, which will appear from

Patna High Court CR. MISC. No.71046 of 2019(3) dt.20-12-2019 2/2 para 17 and 18 as well as other paragraphs of the case diary and petitioner has been in custody since 01.02.2019.. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, this application is allowed, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -IV, Gaya, in connection with Magadh Medical P.S. Case No. 148 of 2018 subject to the condition that petitioner shall cooperate in disposal of trial and make himself available as and when required by the Trial Court.
