2. The petitioner is apprehending his arrest connection with Kotwali P.S. Case No. 532 of 2023, F.I.R. dated 18.07.2023 registered for the offences punishable under Sections 365/366 of the Indian Penal Code.

3. The prosecution case, in brief, is that the wife of the informant had gone to Maurya Lok. Thereafter, she disappeared from there and the F.I.R. was lodged against unknown.

4. Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has been falsely implicated in the present case and in fact the petitioner is not named in the F.I.R. and the name of the petitioner has been

Patna High Court CR. MISC. No.80810 of 2023(2) dt.24-01-2024 2/2 transpired during investigation and during investigation some of the photographs collected by the Investigation Officer which suggests that the petitioner has relation with the victim and the victim has not yet recovered.

5. Learned APP for the State, on the other hand, has opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts that there is direct allegation against the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Kotwali P.S. Case No. 532 of 2023 pending in the Court of learned Chief Judicial Magistrate, Patna.

7. Prayer is refused.
