The petitioners seek regular bail in connection with Mehandia P.S.Case No.31 of 2018 registered for offences punishable under Sections 341, 323, 307, 354, 504, 506 of the Indian Penal Code and Section 34 of the IPC.
Allegation against the petitioners and other accused persons is of assault to the informant and when his daughterin- law came to save him, her blouse was torn and she was also assaulted.
Submission of the learned counsel for the petitioners is that there is dispute between the parties and the petitioner is full brother of the informant. Injuries on the person of the informant was found to be simple in nature though the opinion about the
Patna High Court Cr.Misc. No.71699 of 2018(2) dt.12-12-2018 2/2 injury of the daughter- in- law of the informant has been kept reserved. The petitioner no.1 is in custody for more than six months and the petitioner no.2 is in custody for five months. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Arwal in connection with Mehandia P.S.Case No.31 of 2018. With the aforesaid observation, this application is allowed.
