====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 04-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Industrial P.S. Case No. 107 of 2015 instituted for the offence under Sections 395, 397 of the Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that First Information Report is against unknown. Petitioner has not been put on Test Identification Parade. There is no recovery of any incriminating article from possession of the petitioner. The name of petitioner has come in the confessional statement of co-accused Mukesh Kumar who has already been granted bail by coordinate Bench of this Court vide order dated 28.6.2016 passed in Cr. Misc. 17756 of 2016.
Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.71188 of 2018(2) dt.04-12-2018 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Industrial P.S.
