JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 20-06-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for bail in a case instituted for the offence under Sections 341, 323, 504, 506, 307/34 of the Indian Penal Code and Section 27 of the Arms Act. As per allegation in the FIR, while the informant was walking, over a trivial dispute, petitioner and co-accused Sanjay Mahto and one another started to abuse the informant and in the meantime, accused Ranjay Mahto opened fire causing into gun shot injuries on his left hand and neck of the informant Bhola Saw.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. No one is the eye witness of the alleged occurrence. It appears from

Patna High Court CR. MISC. No.717 of 2023(4) dt.20-06-2023 2/2 perusal of para 73 of the case diary that injury report of the informant has not been prepared so the same is not brought on record to support the prosecution story. Petitioner is languishing in judicial custody since 13.09.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of theACJM-II, Jamui in connection with Lachhuar P.S.
