The petitioner seeks bail in connection with Kesariya P.S. Case No. 163 of 2018 arising out of G.R. Case No. 3049 of 2018 instituted for the offence under Section(s) 420 and 379 of the Indian Penal Code.
It is alleged in the written report that informant received call on his mobile no. 8126140306 from mobile no 9065721672 stating that his ATM will be closed and caller enquired about his ATM card and thereafter informant found that total five transactions have been made from his account totalling an amount of Rs. 29,998 and thereafter ATM was closed.
Learned counsel for petitioner submits that petitioner
Patna High Court Cr.Misc. No.74441 of 2018(2) dt.13-12-2018 2/2 is not named in the written report. Police has arrested this petitioner and recorded his confessional statement. It has further been submitted that there has been no any credit of amount in the account of this petitioner from account of informant. Petitioner has no concern with the alleged occurrence. Petitioner is in custody since 9.7. 2018.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XI, Motihari in connection with Kesariya P.S. Case No. 163 of 2018 arising out of G.R. Case No. 3049 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner.
